1. The business relationship between Erzi GmbH and the client, who is the end user (customer) are subject to the following terms &conditions as amended at the time the order is placed. Different terms & conditions of the Purchaser shall not be applicable, unless Erzi GmbH expressly agrees to their validity. Applicable law shall be the law of the Federal Republic of Germany; the CISG shall not apply. 2. Formation of Contract Placing orders in our online shop shall require free registration as a customer. By registering the customer does not undertake any obligation, details to be entered are limited to those required to establish and maintain the contractual relationship, i.e. a valid e-mail address, first and last name and full address. In addition, assignment of a personal password is required. From the home page of our online shop, the customer enters the selection page, where he, being a private consumer, shall click on the right side of the screen on "Take me to the retail sector." There, the customer may call each product and read the description of each item by clicking on the product picture. Clicking on the cart icon places the item in the shopping cart without obligation. This does not yet result in an order. Customer may take a look at the current contents of the shopping cart by clicking on the orange highlighted link "my cart" shown on the right side of the screen. The minimum order value in our online shop is 10.00 Euro without shipping. To place a binding order, the customer shall also click on the link "my cart". Now he may correct the contents of the cart and thus of the order by changing the indicated quantity for each item and clicking on the "update" link below the total price. If the customer enters a "0" as the number of pieces at this point, the corresponding article is removed from the cart after updating and will therefore not be ordered. In the shopping cart the shipping costs accruing for the current order will be shown and added to the total price of the items listed. After clicking on the "Checkout" link on the shopping cart page the customer will be taken to the registration. The content of the cart remains in place during registration. If the customer is already registered, he shall enter his login information there. Unregistered customers have to enter a valid e-mail address at this point. By clicking on the "Register" link the customer is taken to the page where he can enter his first and last name and full address. The boxes marked with an asterisk must be filled out in order to successfully register and for ordering. In addition, the customer must allocate a password. By clicking on the "Register" link the customer is taken to the page where he my click on his preferred method of payment and enter different shipping and billing addresses. This does not trigger an order yet. By clicking the back arrow the customer goes back to the previous page, where he may make any corrections. By clicking on the "Next", link the customer returns to the shopping cart display which has now been supplemented by shipping and billing addresses and the method of payment. The customer may correct these supplements by clicking on the "Change." link The items in the shopping cart may not be changed on this page. To do so, the customer must click on the orange highlighted "My Cart" link link on the right side of the screen again and make the corrections there. To place a binding order, the customer must confirm that he has read the general terms & conditions and agree to them by ticking the box. He may also have them displayed again by clicking on "Terms". When clicking on the "Order" link the items shown in the shopping cart at this point are firmly ordered. Then a correction of the data is no longer possible. The next page shows the number assigned to the current order. Immediately, an e-mail confirming the receipt of his order is sent to the e-mail address indicated by the customer. This confirmation does not yet mean acceptance of the agreement by Erzi GmbH. The above confirmation e-mail again contains all the details of the order (items, quantity and unit price, total price including shipping costs, delivery address, billing address, payment method, order number), thus allowing the customer to store those details as text of the agreement. Erzi GmbH does not save the text of the agreement. The agreement is concluded upon delivery of the ordered items to the customer. 3 Delivery Erzi GmbH will charge customer a fee of Euro 6,95 for postage and handling. Delivery of bulky goods shall require prior agreement with customer regarding extra shipping costs and delivery date. Orders are shipped after Erzi GmbH has received payment of the total price of the order. If, despite careful storage management, an ordered item is out of stock upon payment receipt, the customer will be notified. If he accepts later delivery, delivery of the items concerned shall be free of charge. Deliveries will be made only to valid postal addresses (no PO boxes) within the Federal Republic of Germany. We kindly ask the customer to check the package for visible damage upon acceptance of the order from the carrier and to report any damage to the representative of the shipping company without undue delay. Failure to do so will have no impact on customer's rights under the purchase agreement. 4. Right of revocation Revocation instructions You may revoke your stated agreement within 14 days in writing (e.g. by letter, fax, e-mail) without giving any reasons or - if the goods have been handed over to you before the end of the revocation period - by returning the item concerned. The period begins upon receipt of this written notification, but not before receipt of the goods by consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery), nor does it begin before we have met our information duty according to article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and or before meeting our obligations according to § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 BGB. (EGBGB = Introductory Law to the German Civil Code, BGB = German Civil Code). In order to meet the revocation requirements it is sufficient to send the revocation or the item in time. If you are unable to return the received services or uses (e.g. benefit of use) fully or in part, or if you can only return them in deteriorated condition, you will have to pay compensation to us. You will be liable for deterioration and derived benefits only, if the uses or deterioration are due to handling of the goods beyond a test of their characteristics and functioning. Testing of characteristics and functioning" shall mean the testing and evaluation of the respective goods, as it would be possible and normal in a conventional shop. Items suitable for parcel-post shipment shall be returned at our expense and risk. Items not suitable for parcel-post shipment will be collected at your place. Any obligations to reimburse payments must be fulfilled within 30 days. The period shall start for you when you send your revocation statement or the goods and for us upon their reception.
Erzi GmbH will collect personal information only and to the extent customer supplies them to us knowingly himself. In particular, personal data will only be used for purposes of advertising / market research and design of our services, if the customer has expressly given his consent thereto. The customer may revoke any such consent given any time.
